  • Cancellation of a Sale Deed legally voids the agreement, often due to issues such as financing delays, mutual withdrawal, or documentation errors. 
  • Registration Charges are separate fees paid for registering documents; these are typically non-refundable, unlike stamp duty (which may be refunded under specific conditions). 

 How Does Stamp Duty Work in India?  

Stamp duty is a state-level tax levied on property transactions. It is calculated on the market value or agreement value of the property, whichever is higher, and must be paid before registration of the sale deed. The rates vary by state, property type, location, and buyer category (e.g., individual, woman, company). 

 How is Stamp Duty Calculated on Property Transactions?  

In Maharashtra, the calculation is guided by ready reckoner rates published annually by the authorities. The higher of the agreement value or government-assessed market value becomes the basis for stamp duty calculation.  

 What Happens if You Cancel a Recent Property Purchase? 

If a property transaction is cancelled after stamp duty has been paid but before or after registration, the buyer may file a refund claim. The cancellation must be documented (via a Deed of Cancellation or court order), and the refund application should be made within a 6-month window from the date of cancellation. 

 What is a Sale Deed and What Does Cancellation Mean? 

A sale deed is a legally binding document that confirms the transfer of property ownership from the seller to the buyer. 
Deed cancellation refers to legally annulling this transaction either by mutual consent (through a Deed of Cancellation) or via legal intervention, making the original agreement void. 

 Process of Cancelling a Sale Deed  

  1. Draft a Deed of Cancellation, signed by all parties. 
  2. Register the cancellation deed at the same Sub-Registrar office where the original deed was registered. 
  3. Retain copies of both sale and cancellation deeds as supporting documents for refund application. 

 Stamp Duty Refund Process for Cancelled Sale Deeds 

As per the Maharashtra Stamp (Refund) Rules, 1963, a refund of stamp duty is allowed if: 

  • The deed is cancelled by mutual agreement or court order. 
  • The refund claim is made within 6 months of cancellation. 
  • The original stamped document is submitted along with the claim.
